By accessing Dumonde Group LLC / D.B.A. Dumonde Travel Website (www.traveldm.com), you hereby accept and agree to be bound by and comply with the terms that govern its use (the “Terms”). You must not use the site if you do not accept the Terms.
Dumonde Travel does not act as principal but makes arrangements with third-party vendors , such as, but not limited to airlines, hotels, cruise lines, railroads, car rental agencies, tour operators and consolidators, traveler assist service providers, insurance providers and activities suppliers (each a "Travel Supplier") for travel-related services which include, without limitation, air transportation, lodging, and car rental (each a "Service Element").
By using this Website, you acknowledge that the rates offered by Dumonde Travel and affiliate companies are a result of negotiation between Dumonde Travel and the Travel Suppliers and include certain fees retained by them for their services, taxes and other charges. When booking with any Travel Supplier thru this Site, you authorize Dumonde Travel and affiliate companies to book reservations or enter a contract on your behalf with Travel Suppliers for the total price displayed, including such fees and any applicable taxes or charges related to the Travel Supplier's or Dumonde Travel's services.
USE OF THE WEBSITE
As a condition of your use of this Website, you warrant that:
You are at least 18 years of age;
You possess the legal authority to create a binding legal obligation;
You will use this Website in accordance with these Terms of Use;
You will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorized to act;
You will inform such other persons about the Terms of Use that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto;
All information supplied by you on this Website is true, accurate, current and complete; and
If you have a Dumonde Travel account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by you and anyone other than you.
We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms of Use.
Reasonable effort is made to ensure that the Information is current and accurate, but please note that the site is provided “as is”. Dumonde Travel does not warrant the accuracy, adequacy, timeliness or completeness of the Information or the Site and expressly disclaims liability for errors or omissions in the Information or the Site.
No warranty of any kind, implied, express or statutory is given in conjunction with the Information or the Site and the accuracy of the Information should be confirmed before you rely on it. Dumonde Travel does not represent or warrant that the Site will be available and will meet your requirements, that access will be uninterrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information.
Dumonde Travel shall not be liable for errors or inaccuracies on the Site, or the failure of Travel Suppliers from whom you obtain services through this Site, including but not limited to airlines, hotels, cruise lines, railroads, car rental agencies, tour operators and consolidators, vacation packages, activities suppliers, traveler assist service providers and insurance providers. Dumonde Travel, in providing travel management services, does not endorse, guarantee or insure the products or services which are provided by an external supplier, the financial position of such suppliers or the reimbursement to you from any loss as a result of the financial condition of such supplier. In the event that a supplier defaults prior to providing the service to you where a payment has been made, your sole recourse for a refund shall be the defaulting supplier, from insurance covering such defaults if any, or from other responsible third party unless such loss was caused solely by Dumonde Travel. In those situations in which a supplier defaults prior to providing services you may pursue any recourse against the supplier for a refund, as permitted by law or statute.
Dumonde Travel does not represent or warrant that the website will be available and meet your requirements, that access will be uninterrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system. You have sole responsibility for adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for computer viruses or other destructive properties.
In no event will Dumonde Travel be liable to you or any other party for any incidental, consequential, punitive, special or indirect damages, claims, losses or expenses (collectively, “Damages”) arising from the use of the Site or the Information or from any action or decision made relying on the Site or the Information, even if Dumonde Travel has been advised of the possibility of these damages. The use of this Site is entirely and completely at your risk
PROHIBITED ACTIVITIES
The content and information on this Website (including, but not limited to, price and availability of travel services) as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. While you may make limited copies of your travel itinerary (and related documents) for travel or service reservations booked through this Website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this Website. Additionally, you agree not to:
Use this Website or its contents for any commercial purpose;
Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
Access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
Violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;
Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
If your booking or account shows signs of fraud, abuse or suspicious activity, Dumonde Travel may cancel any travel or service reservations associated with your name, email address or account, and close any associated Dumonde Travel accounts. If you have conducted any fraudulent activity, Dumonde Travel reserves the right to take any necessary legal action and you may be liable for monetary losses to Dumonde Travel, including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact Dumonde Travel Customer Service.
CANCELLATIONS, CHANGES AND CHARGES
The chance to modify or change a travel product or service booked through this Website, and the manner in which to do so, will depend on the terms and conditions of your Travel Provider/s, associated to the fare type selected. Therefore, it may not be possible to cancel or modify the products or services requested, or it may be necessary to comply with specific requirements. In the event of You making any modifications to your purchase (cancellation and/or modification) through Dumonde Travel, an administration fee will be charged of ONE HUNDRED DOLLARS ($100) per person, plus any additional airline fees and journey cancelled and/or modified. These administration fees for cancellation and/or modification do not include taxes charged directly by your Travel Provider/s. In the event that You make a change to your purchase, please note that the current price does not bear any relation to the cost of making the change.
In relation to the purchase of flight tickets, please note that for itineraries consisting of different routes and more than one base fare, more than one set of fare rules may apply. In this instance, the most restrictive fare rules will be applied. You should read all fare terms and conditions relating to your booking. If changes or cancellations are permitted, they can be effective by calling Dumonde Travel. Please note that if You have purchased a return ticket, a ‘no show’ for the outward journey may result in your return ticket being cancelled by the airline.
In relation to hotel bookings, the hotel’s specific terms and conditions for cancellations and modifications will be available to view on our Website during the booking process or by prior request to our Customer Service centre, which will also be explained in your confirmation email. When You modify a booking, it is your responsibility to ensure that it does not conflict with any other product or service You have purchased.
A NON-REFUNDABLE Service Fee of $15 (Fifteen US Dollars) will be charged on your Credit Card for every Hotel Reservation you create on this Website. The Service Fee charge will appear on your bank statement as "Dumonde Travel" charge.
In relation to car rentals, the car rental provider’s specific terms and conditions for cancellations and modifications will be available to view through a link on our Website or by prior request to our Customer Service centre. Please, note that if You fail to cancel your booking prior to the pick-up time and do not collect the vehicle on the pick-up date, or of You fail to comply with the pick-up terms (see car supplier terms and conditions), most of the car rental providers reserve the right to make a ‘no show’ charge of up to 100% of the total value of the vehicle rental.
In relation to the purchase of cruise line tickets, the specific terms and conditions of the cruise line Travel Provider relating to cancellations and modifications will be available on the documentation supplied directly by the Travel Provider and/or on their Website. You may not manage any bookings relating to the purchase of cruise tickets directly on the Dumonde Travel Website, as Dumonde Travel only provides space on its Website for the promotion of their products and/or services. Please note that if You fail to cancel your booking prior to the pick-up time and do not take the cruise on the pick-up date, or of You fail to comply with the pick-up terms
TRAVEL ADVISORY – VISA REQUIREMENTS
Although most travel is completed without incident, travel to certain destinations may involve greater risk than others. We urge passengers to review travel prohibitions, warnings, announcements and advisories issued by their governments prior to booking travel, particularly when travelling to international destinations.
By displaying Accommodations in particular destinations, Dumonde Travel does not represent or warrant that travel to such points is advisable or risk-free and Dumonde Travel can never be held liable for damages or losses that may result from travel to such destinations. Dumonde Travel can under no circumstances be held liable for any incidents occurring during your stay at the Accommodation. You are strongly advised to check the relevant travel advisories issued by your government for any country you are visiting and to take the necessary precautions. You are also advised to take personal travel insurance.
Dumonde Travel cannot be held liable for any loss incurred in the event of your failure to hold the necessary passports, visas and documentation for your journey. You are advised to check with the relevant embassies, consulates and/or visa departments of the countries you wish to visit. It is your responsibility to obtain whatever travel documents are required.
Please note that some countries have strict rules and regulations on the import of restricted or prohibited goods, items or substances. These can include but are not necessarily limited to alcohol, tobacco, perfumes, drugs, medication, books, movies, DVDs, adult entertainment materials, food stuffs, plants, animal parts, etc. It is your responsibility to verify and comply with applicable regulations. Non-compliance can lead to severe penalties.
WAIVER
By using the Site, you agree to irrevocably waive any claim against Dumonde Travel, its subsidiaries or affiliates, and any of such party's officers, directors, managers, agents, contractors, or employees, and expressly agree that neither Dumonde Travel nor any of its subsidiaries, affiliates, officers, directors, managers, agents, contractors or employees, shall be held liable for:
Any loss of or damage to property or injury to any person caused by reason of any defect, negligence, or other wrongful act of omission of, or any failure of performance of any kind by any Travel Supplier;
Any inconvenience, loss of enjoyment, mental distress or other similar matter;
Any delayed departure, missed connections, substitutions of accommodations, terminations of service, or changes in fares and rates;
Any cancellation or double-booking of reservations or tickets beyond the reasonable control of Dumonde Travel; and
Any claim of any nature arising out of or in connection with air or other transportation services, products or other features performed (or not) or occurring (or not) in connection with your itinerary.
For avoidance of doubt (and without limiting the foregoing), Dumonde Travel does not assume any liability whatsoever for cancelled flights, flights that are missed, or flights not connecting due to any scheduled changes made by the relevant airline.
RESOLUTION OF DISPUTES
Customer satisfaction is the foundation of our success. That's why, if a dispute arises between us, our goal is to resolving the dispute quickly in a fair and cost-effective way. Otherwise, you and we agree that we will resolve any dispute, claim or controversy arising out of or relating to your use of the Site, these Terms & Conditions, or the breach, termination, enforcement, interpretation or validity thereof, or our relationship in connection with the Site or these Terms & Conditions (each, a "Claim"), in accordance with one of the subsections below or as otherwise mutually agreed by the parties in writing.
DISCLAIMER OF WARRANTIES
ALL CONTENT, INCLUDING SOFTWARE, PRODUCTS, SERVICES, INFORMATION, TEXT AND RELATED GRAPHICS CONTAINED WITHIN OR AVAILABLE THROUGH THE SITE ARE PROVIDED TO YOU ON AN "AS IS," "AS AVAILABLE" BASIS. DUMONDE TRAVEL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS WEBSITE OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED ON THIS WEBSITE AND TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, DUMONDE TRAVEL DISCLAIMS ALL REPRESENTATIONS, CONDITIONS AND WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED CONDITIONS OR WARRANTIES OF MERCHANTABILITY OR SATISFACTORY WORKMANLIKE EFFORT, INFORMATIONAL CONTENT, TITLE, OR NON-INFRINGEMENT OF THE RIGHTS OF THIRD PARTIES. DUMONDE TRAVEL DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS THAT THE SITE WILL OPERATE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE AND/OR ITS SERVERS WILL BE FREE OF VIRUSES AND/OR OTHER HARMFUL COMPONENTS. DUMONDE TRAVEL DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING SUITABILITY, AVAILABILITY, ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY MATERIAL OF ANY KIND CONTAINED WITHIN THE SITE FOR ANY PURPOSE, INCLUDING SOFTWARE, PRODUCTS, SERVICES, INFORMATION, TEXT AND RELATED GRAPHICS CONTENT.
DUMONDE TRAVEL IS NOT RESPONSIBLE FOR ANY FAILURES CAUSED BY SERVER ERRORS, MISDIRECTED OR REDIRECTED TRANSMISSIONS, FAILED INTERNET CONNECTIONS, INTERRUPTIONS IN THE TRANSMISSION OR RECEIPT OF RESERVATIONS OR, ANY COMPUTER VIRUS OR OTHER TECHNICAL DEFECT, WHETHER HUMAN OR TECHNICAL IN NATURE.
GENERAL LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DUMONDE TRAVEL, INCLUDING ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, SUBSIDIARIES, AFFILIATES, DISTRIBUTORS, SUPPLIERS, LICENSORS, AGENTS OR OTHERS INVOLVED IN CREATING, SPONSORING, PROMOTING, OR OTHERWISE MAKING AVAILABLE THE SITE AND ITS CONTENTS (COLLECTIVELY THE "COVERED PARTIES"), BE LIABLE TO ANY PERSON OR ENTITY WHATSOEVER FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, COMPENSATORY, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR ANY DAMAGES OR LOSSES WHATSOEVER, INCLUDING BUT NOT LIMITED TO (WHERE RELEVANT, CAUSED BY): (I) LOSS OF PRODUCTION, LOSS OF PROFIT, LOSS OF REVENUE, LOSS OF CONTRACT, LOSS OF OR DAMAGE TO GOODWILL OR REPUTATION, LOSS OF CLAIM, BUSINESS INTERRUPTION, DATA OR OTHER INTANGIBLE LOSSES; (II) YOUR INABILITY TO USE, UNAUTHORIZED USE OF, DELAY, PERFORMANCE OR NON-PERFORMANCE OF THE SITE; (III) UNAUTHORIZED ACCESS TO OR TAMPERING WITH YOUR PERSONAL INFORMATION OR TRANSMISSIONS; (IV) THE PROVISION OR FAILURE TO PROVIDE ANY SERVICE, INCLUDING SERVICES RENDERED OR PRODUCTS OFFERED BY THE ACCOMMODATION, (PARTIAL) CANCELLATIONS OR OVERBOOKINGS; (V) ERRORS OR INACCURACIES CONTAINED ON THE SITE OR ANY INFORMATION (INCLUDING BUT NOT LIMITED TO THE (DESCRIPTIVE) INFORMATION (INCLUDING RATES, AVAILABILITY AND RATINGS) OF THE ACCOMMODATION AS MADE AVAILABLE ON THE SITE), SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS OBTAINED THROUGH THE SITE; (VI) ANY TRANSACTIONS ENTERED INTO THROUGH THE SITE; (VII) ANY PROPERTY DAMAGE INCLUDING DAMAGE TO YOUR COMPUTER OR COMPUTER SYSTEM CAUSED BY VIRUSES OR OTHER HARMFUL COMPONENTS, DURING OR ON ACCOUNT OF ACCESS TO OR USE OF THE SITE OR ANY SITE TO WHICH IT PROVIDES HYPERLINKS; OR (VIII) DAMAGES OTHERWISE ARISING OUT OF THE USE OF THE SITE, ANY USE, DELAY OR INABILITY TO USE THE SITE, OR ANY INFORMATION, PRODUCTS, OR SERVICES OBTAINED THROUGH THE SITE; OR (IX) ANY (PERSONAL) INJURY, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES ATTRIBUTABLE TO THE ACCOMMODATION (ITS EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, REPRESENTATIVES OR AFFILIATED COMPANIES) (X) ANY DAMAGES CAUSED BY A FORCE MAJEURE EVENT. THE LIMITATIONS OF LIABILITY SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF A COVERED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
A force majeure event is any event beyond the Covered Parties’ control and can include, but is not limited to, natural disasters, weather conditions, fire, nuclear incident, electro-magnetic pulse, terrorist act, riots, war, arson attacks, insurgency, rebellion, armed hostilities of any kind, labor disputes, lockouts, strikes, shortages, government actions or restraints, pilferage, bankruptcy, machinery breakdown, network or system interruptions or breakdown, internet or communications breakdown, quarantine, epidemic, pandemic etc. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Party shall be responsible for any Accommodation’s breach of any condition or warranty including, but not limited to, implied conditions or warranties of fitness for a particular purpose or of merchantability, nor shall any Covered Party be responsible for any other wrongdoing of a Accommodation (including any liability in tort), as to any products and/or services available through the Site. Dumonde Travel does not guarantee continuous access without interruption to the Site.
Dumonde Travel’s liability is excluded or limited to the maximum extent permitted by law. Without prejudice to the limitations set out in the Terms of Use, Dumonde Travel’s liability shall in any event not exceed the lesser of (a) the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events) or (b) two hundred and fifty United States dollars (or its equivalent in local currency). Claims should be submitted as soon as possible after occurrence of the event giving rise to the claim. Claims with undue delay may be considered void. Only bona fide claims will be considered.
The Website, the Information and the Terms will be governed by laws of the State of Florida, United States of America. All disputes, controversies or claims arising out of or in connection with the Website, shall be submitted to and be subject to the exclusive jurisdiction of the federal and state courts located in Miami-Dade County, the State of Florida, United States of America, in all questions and controversies arising out of your use of this site and this Agreement.
